The operator of the e-shop Psycholog Toth s.r.o. at www.se-edu.eu, ID No. 09028340, registered office Slatina nad Zdobnicí 200, 517 56, processes personal data provided by the Buyer for the purpose of fulfillment and additional confirmation of the Terms and Conditions, for the purpose of processing the electronic order, realization of the delivery, settlement of payments and necessary communication between the contracting parties for the period required by special legislation.

Purpose and scope of the processing of personal data

Personal data is processed in accordance with Regulation 2016/679 of the European Parliament and of the Council (hereinafter referred to as the GDPR, hereinafter referred to as the Regulation) and Act No. 110/2019 Coll., on the processing of personal data, as amended (hereinafter referred to as the Act). 

1. Basic provisions

  1. The controller of personal data is Psychologist Toth s.r.o., ID No. 09028340 with registered office Slatina nad Zdobnicí 200, 517 56 (hereinafter referred to as the "Controller");
  2. The contact details of the administrator are: e-mail: ondra@se-edu.eu.
  3. Personal data means all information identifying a natural person.

2. Sources of personal data processed

  1. The controller processes personal data obtained directly from the data subject (buyer) when:
    1. Register a user account on the website www.se-edu.eu.
    2. Filling out an order form to purchase goods or services.
    3. Communication with us, for example by email or telephone.
  2. The processing of personal data is carried out on the following legal bases:
    1. Performance of the contractA: The processing is necessary for the conclusion and performance of the Purchase Agreement (including order processing, delivery of digital content, settlement of payments and necessary communication between the parties). This includes, in particular, identification and contact data (name, address, e-mail, billing data and telephone, if applicable).
    2. Fulfilling a legal obligation: The processing is necessary to comply with obligations under applicable law, such as accounting and tax laws (e.g. retention of tax documents).
    3. Legitimate interest: The processing is necessary for the purposes of the legitimate interests of the Controller or a third party, for example: 
      • Verification of the purchaser's qualifications (completed Somatic Experiencing® training or at least 1st year of training) for the purposes of registration approval and to provide access to specific products for the professional community.
      • Protect the rights and legitimate interests of the Controller (e.g. debt recovery, protection of property and intellectual property).
      • Security of websites and systems.
    4. Consent of the data subject: In cases where consent is explicitly required and there is no other legal basis for the purpose, e.g. for:
  3. Sending commercial communications (newsletters).
  4. Recording webinars and then making the recordings available to other paying buyers, as detailed in the section "Webinar recordings and distribution".

3. Processing of webinar recordings

  1. Webinar recordings and dissemination The Administrator makes recordings of webinars for the purpose of enabling repeat viewing by registered and paying purchasers who have purchased the webinar. These recordings are made available to purchasers in the members' section of the web interface of the shop.
  2. Legal basis for the processing of personal data in connection with the recording of webinars is consent of the participants. This consent relates to the recording of their participation in the webinar.
  3. In the event that the webinar includes a demonstration of direct work of the trainer with the client/participant, or if the participant performs during the webinar in such a way that he/she becomes identifiable and his/her performance is part of the recording for further dissemination (e.g. asks a question with the camera on), for this particular processing and making the recording available to other buyers, a request is made for separate, informed and voluntary consent of the person in advance of, or immediately after, such performance. If such consent is not given or is withdrawn, the Controller shall ensure that this part of the recording is not disclosed..
  4. Consent to the recording of the webinar and its accessibility for purchased buyers is given by the participant by checking the appropriate box before completing the order or registration. Participants do not have the right to redistribute the recording of the workshop to third parties.

4. Purpose of the processing of personal data

The controller processes the personal data of the buyer for the following specific purposes:

  1. User account management and registration: To enable you to create and manage your user account on the www.se-edu.eu website, verify your qualifications (e.g., completed Somatic Experiencing® training or at least year 1 of training), and provide access to the member section and products designed for the professional community.
  2. Handling and fulfilling orders: To process your electronic orders for digital content (workshops, webinars, recordings, presentations), deliver the purchased content (making it available in the member's area or sending links), settle payments and issue tax documents - invoices.
  3. Communication with customers: For the necessary communication between the contracting parties, providing information on purchased events (e.g. links to join webinars), answering your questions and handling complaints or claims.
  4. Sending commercial communications (newsletters)To inform you about upcoming events, workshops, webinars and other news and offers related to SE edu's activities, if you have given your consent.
  5. Provision and archiving of webinar recordings: To capture recordings of webinars and then allow them to be viewed again by registered and paying purchasers who have purchased the webinar.
  6. Protection of the rights and legitimate interests of the Controller: To protect property and intellectual property (e.g. to prevent unauthorised distribution of purchased content), to recover debts and to ensure the security of the website and systems.
  7. Fulfilling legal obligations: To comply with obligations under applicable laws such as accounting and tax laws (e.g. keeping tax documents).

5. Retention period of personal data

  1. The controller shall retain personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship and after its termination for the period required by the relevant legislation (in particular Act No. 563/1991 Coll., on Accounting, as amended, and Act No. 280/2009 Coll., Tax Code, as amended), generally for a period of 10 years. After the expiration of the retention period, the Controller is obliged to delete the data.After the expiration of the retention period, the Controller is obliged to delete the data.

6. Recipients and processors of personal data

Your personal data may be transferred to our subcontractors and other processors to ensure the operation of our e-shop and the provision of services. We have data processing agreements with these partners that guarantee the protection of your data.

These processors include:

  • The e-shop provider (Webnode AG).
  • Web analytics tools (Google Analytics).
  • Platform for webinars (ZOOM).
  • Persons providing web administration and development (Lenka Havrlantová).
  • Payment service providers.

Please note that some of our processors may transfer personal data to the United States. In these cases, we take care to ensure that all GDPR data protection requirements are met for international transfers.

7. Buyer's rights

Under the terms of the Act, the buyer has the right to:

  1. To access your personal data;
  2. To correct personal data;
  3. To delete personal data;
  4. Object to processing;
  5. On data portability;
  6. Withdraw consent to the processing of personal data in writing or electronically at the following e-mail address: ondra@se-edu.eu;
  7. The option to unsubscribe from the newsletter will be in every newsletter. 

File a complaint with the Office for Personal Data Protection if he/she believes that his/her right to personal data protection has been violated.

8. Security of personal data

  1. The Controller declares that it has taken all appropriate and reasonable technical and organisational measures to safeguard personal data against unauthorised access, alteration, loss or destruction, including measures for data storage and network security.

9. Final Provisions

  1. By submitting an electronic order on the website www.se-edu.eu the buyer confirms that he/she has been informed of the Privacy Policy and accepts it in its entirety;
  2. The buyer agrees to these Rules by checking the box in the order;
  3. The Controller is entitled to update or change this Privacy Policy at any time. The new version of the Rules shall take effect on the date of its publication on the website www.se-edu.eu. Registered purchasers will also be informed of this change by e-mail.

The rules are written in Czech and English. In the event of any conflict between the Czech and English versions, the Czech version shall prevail.

These Rules come into force: 1. 7. 2025.
